Recently, several large-scale cartels and bid-rigging allegations have been reported in the media, and several of these cases have occurred in industries that were not necessarily considered to have high cartel risks.Even if a violation of the Antimonopoly Act is committed, penalties can be minimized through leniency (surcharge reduction/exemption system), and in that sense, it is extremely important to deter violations and take appropriate measures when suspected cases are discovered. This is important, and if you mishandle this and miss the opportunity to apply for leniency, you may not only be subject to administrative fines but also risk shareholder derivative litigation.
Furthermore, with the revision of the Antimonopoly Act in XNUMX, a cooperation subtraction system was introduced in the leniency system, making continuous cooperation and dialogue with the Fair Trade Commission important. In this seminar, we will organize and discuss the points that corporate legal affairs and compliance departments should be aware of from normal business times, taking into account the actual operation after the revised law comes into effect.
Program
1 Trends in enforcement against cartels in Japan and overseas
2 Overview of the revised leniency system
3 Preparations during peacetime, including secret privileges (discrimination system)
Only members can watch it.
Please refrain from registering at a law firm, in the same industry as our company, or with a free email address.
