In South Korea, a law called the Act on Punishment of Serious Disasters has been in effect since January 2022, 1. The Industrial Safety and Health Law already exists with regard to safety and health at work sites, but this law was enacted with the aim of preventing the occurrence of accidents by building a safety and health management system not at the workplace but at the management level. For this purpose, this law imposes obligations on representatives, etc., rather than on-site supervisors, and the sanctions for violation of obligations are extremely heavy, including imprisonment.
In the event of a serious disaster involving a Korean subsidiary or joint venture of a Japanese company, the potential impact of this law is very significant, as employees dispatched to the company as executives may be ordered to stop leaving the country once an investigation is initiated. Japanese companies doing business in Korea are probably already considering and implementing measures to comply with this law.
