Overview
In recent years, the Fair Trade Commission has been actively enforcing the law against cartels and collusion (unfair trade restrictions).
Even in 2024, numerous cease and desist orders and surcharge orders have already been issued and made public.
For example, the number of cease and desist orders and surcharge payment orders in 2023 was three, but only half a year has passed in 3, and the number has already more than doubled to seven. In addition, on July 2024, 2, it was reported that the Fair Trade Commission notified four major non-life insurance companies that it had recognized a price cartel for insurance premiums for corporate insurance contracts, and regulations against cartels and collusion are expected to become even stronger.
If a cartel or bid-rigging case is uncovered, not only will a large amount of fines be imposed, but there is also the risk that subsequent damages lawsuits and suspension of bidding eligibility will be required. In addition, the Fair Trade Commission's announcement and media coverage will inevitably damage the company's reputation.
Therefore, it is important to prevent violations before they occur and, if a violation has already occurred, to detect it early and reduce the impact by preventing or detecting cartels and collusion early, as well as taking appropriate post-incident measures.
