Overview
Recently, companies in various industries and business types have fallen victim to cyber attacks, including ransomware, and there have been cases where it has taken a long time to restore operations and caused huge losses. Furthermore, the leak of information owned or managed by a company can damage the company's reputation and lead to a significant decline in corporate performance, depending on how it is handled. In either case, if a company is the victim of a cyber attack or information leak but does not respond appropriately in peacetime or in times of emergency, the company or its executives run the risk of being sued for damages or held criminally liable.
In this way, to deal with cyber attacks and information leaks, which pose a great risk to companies, multiple parties involved, such as company management, general affairs department, human resources department, legal department, IT and security department, must work across the organization to implement countermeasures in peacetime and in times of emergency. Attorney Masayuki Otake, who has experience investigating many cases as a prosecutor in charge of cybercrime and intellectual crimes at the Public Prosecutor's Office, will explain the important legal and practical points to be aware of in such cases.
