In this webinar, Steven Cherry and David Bowker, partners in the Washington, D.C. office of WilmerHale, will discuss litigating international disputes from a US perspective. The webinar will address, first, the jurisdictional requirements in US courts to sue and be sued for international disputes, such as the requirements for personal jurisdiction, constitutional due process, and subject matter jurisdiction. It will also touch on questions concerning choice of forum (e.g., whether to litigate or to arbitrate, and where to do so), and determining which jurisdiction’s laws will govern a dispute. Next, the webinar will discuss discovery relating to international litigation, including when discovery may be obtained in the United States for matters that are being litigated abroad, and what type of international discovery US courts permit for matters that are being litigated in the United States. Throughout the webinar, the presenters will share information on current trends and recent court decisions relating to international litigation, including recent issues before the US Supreme Court. They will also provide guidance on how to bring an international dispute in the US courts, and, alternatively, how to avoid being subject to such a suit in the United States.
